Welcome to The Squirrels Nest. Throughout these terms, “we,” “us,” and “our” refer to The Squirrels Nest.

These Terms of Service apply to your use of our website and purchases from our store. Our Shipping Policy, Return and Refund Policy, and Privacy Policy also apply where relevant.

Nothing in these terms limits any rights or remedies you have under applicable consumer protection laws.

Products and card descriptions

We sell trading cards and related products. Each listing identifies the applicable card version, condition, language, and finish, where relevant.

Please review the full listing before purchasing, including the set, collector number, foil treatment, language, condition, and any disclosed damage.

Card condition reflects our assessment of the card’s physical wear. A condition description is not a professional grading certification or a guarantee of a particular grade from a third-party grading company.

Product images may be stock images used to identify a card and its printing. Unless a listing states that photographs show the actual card, images should not be treated as photographs of the specific copy you will receive. Any actual-card photographs and written disclosures form part of that card’s description.

Screen settings and lighting may affect how colours and foil finishes appear. This does not affect our responsibility to supply the card version and condition described in the listing.

Prices and currency

All prices are in Canadian dollars (CAD), unless expressly stated otherwise.

Applicable taxes and shipping charges are shown at checkout before you complete your purchase.

Prices may change as market conditions change. Price changes after an order is placed do not, by themselves, entitle either party to change the agreed purchase price. We do not offer retroactive price matching or refunds solely because a card’s market value changes.

Orders and availability

Please ensure your order details, contact information, and shipping address are accurate before completing your purchase.

An automated order confirmation acknowledges receipt of your order. It does not guarantee that every item is available or that an order containing an error has been accepted.

If an item is unavailable or we identify a material error in its listing or price, we will contact you promptly. We will not substitute a different card, condition, language, or finish, or charge a higher price, without your agreement.

If we cannot fulfil an item, we will refund the amount paid for that item and any applicable taxes. If we cancel your entire order, we will refund all amounts paid, including shipping.

We may decline or cancel orders where reasonably necessary to address suspected fraud, payment problems, inventory errors, or legal requirements. We will notify you and refund any amounts collected for cancelled items.

Payments

Payment must be successfully processed before an order is dispatched. You must be authorized to use the payment method provided.

Available payment methods are displayed at checkout.

Shipping and delivery

We currently ship only within Canada.

Orders are normally processed within 1–2 business days, excluding weekends and statutory holidays. Processing time is separate from carrier delivery time.

Shipping options, charges, tracking requirements, and other shipping details are explained in our Shipping Policy and displayed at checkout.

Delivery estimates are not guarantees. If your order is delayed, lost, or damaged in transit, contact us at squirrelnestmtg@gmail.com so we can investigate and arrange an appropriate resolution under our Shipping Policy and applicable law.

Choosing an untracked shipping method does not waive your applicable consumer rights.

Order changes and cancellations

Contact us as soon as possible if you need to change or cancel an order. We will try to accommodate requests received before dispatch, but changes may not be possible once processing has begun.

This does not limit any cancellation rights provided by applicable law.

Returns, incorrect items, and condition concerns

Our Return and Refund Policy explains eligibility, reporting instructions, return shipping, and refunds.

Please contact us within 7 calendar days of delivery if you receive the wrong item, undisclosed damage, or a card whose condition materially differs from its listing. Include your order number and clear photographs where possible. This reporting period does not limit any rights you have under applicable law.

Except where required by law, we do not accept returns solely for a change of mind, accidental purchases, or changes in market value.

Wear or damage clearly disclosed before purchase is part of the agreed condition of the card. This does not prevent you from reporting additional undisclosed damage or another material discrepancy.

Contact us before returning an item so we can provide instructions.

Website use

You agree to use our website lawfully and to provide accurate information when placing orders or contacting us.

You must not attempt to gain unauthorized access to the website, interfere with its operation, submit fraudulent orders, or misuse another person’s information.

Intellectual property

Our original website content and branding belong to The Squirrels Nest or their respective rights holders.

Magic: The Gathering names, card artwork, symbols, and related intellectual property belong to Wizards of the Coast and their respective rights holders. The Squirrels Nest is an independent retailer and is not affiliated with or endorsed by Wizards of the Coast.

Purchasing a physical card does not transfer intellectual property rights in its artwork, name, or design. These terms do not prohibit the lawful resale of cards you purchase from us.

Shopify and privacy

Our store is hosted by Shopify, which provides the platform used to operate our website and process orders. Purchases from this store are transactions between you and The Squirrels Nest.

Shopify processes personal information when you visit or purchase from our store. Depending on the features in use, information may be processed with data from interactions with Shopify and other merchants, and may be shared with service providers located outside Canada.

Our Privacy Policy explains how personal information is collected, used, and shared, including Shopify’s role and the privacy choices available to you.

Responsibility and consumer rights

We are responsible for fulfilling orders in accordance with the product descriptions, our published policies, and applicable law.

We cannot guarantee uninterrupted or error-free access to our website. Nothing in these terms excludes or limits any warranty, liability, right, or remedy that cannot lawfully be excluded or limited.

Governing law

These terms are governed by the laws of Ontario and the applicable federal laws of Canada, subject to any mandatory consumer protections that apply where you reside.

Nothing in this section prevents you from exercising rights or bringing proceedings in a jurisdiction available to you under applicable law.

Changes to these terms

We may update these terms from time to time. Updated terms apply prospectively and do not retroactively change the terms of an existing order without your agreement, except as required by law.
